These General Terms of Use (hereinafter the "GTU") govern the access and use of the mobile application "Troky" and the affiliated website www.troky.net (hereinafter collectively the "Platform") made available by TrokyLink SARL (currently being established, registered office in Algiers) (hereinafter the "Publisher").
By accessing or using the Platform, you acknowledge having read and unreservedly accepted these GTU. If you do not accept these GTU, you must refrain from using the Platform.
For the purposes of these GTU, the terms below have the following meaning:
Platform: The mobile application "Troky" and the website www.troky.net.
Publisher: TrokyLink SARL (currently being established), publisher of the Platform.
User: Any natural or legal person using the Platform, publishing ads, messages, reviews, or benefiting from the services.
User Account: Personal space created on the Platform following the User's registration.
User Content: Any text, image, photo, video, review, message, or data published by a User on the Platform.
Connection: Bringing Users into contact with each other for the purpose of exchanging, donating, or renting a good or service.
Any use of the Platform (application or website www.troky.net) implies the full and complete acceptance of these GTU. The User is invited to read this document carefully before any use.
3.1. Access Conditions: Registration is open to natural persons who are 19 years of age or older and have full legal capacity to enter into commitments under these GTU.
3.2. Legal Persons: Registration is open to legal persons if the natural person registering acts in the name and on behalf of that legal person and has the necessary powers to legally bind it.
3.3. Information Provided: Upon registration, the User undertakes to provide accurate, complete, and up-to-date information. They must refrain from impersonating a third party or creating an account for a third party without authorization.
3.4. Confidentiality of Identifiers: The username and password chosen by the User are strictly personal. The User undertakes not to disclose them. They are solely responsible for any use of their Account. The Publisher shall not be held liable for losses or damages resulting from unauthorized use of the Account if these facts result from a disclosure by the User.
3.5. Account Deletion: The User may request the deletion of their Account at any time via the tools provided on the Platform.
The Platform's sole purpose is to connect Users for the purpose of carrying out the exchange, donation, or rental of material goods or services. The Platform offers tools for publishing ads, messaging, rating/reviews, and profile administration.
The Publisher provides a simple technical platform for connecting Users. The Publisher is not a party to the contracts concluded between Users and does not intervene in the execution of private agreements concluded between them (transactions, deliveries, payments, conditions of use of the good or service). Users act under their sole responsibility in their exchanges.
6.1. Guarantee of Legality: The User guarantees that the goods or services offered are legal, that they are the legitimate owner, or that they have all the necessary rights and authorizations to offer them.
6.2. Prohibitions (non-exhaustive list): It is strictly forbidden to offer, promote, or exchange on the Platform:
firearms, narcotics, and illicit substances;
official documents (identity cards, passports, official acts);
controlled medications or pharmaceutical products;
alcohol or tobacco;
illegal services (fraud, hacking, scamming);
any good or service contrary to laws, morality, or the internal policy of the Platform. The Publisher reserves the right to refuse, remove, or moderate any ad or User Content that does not comply.
6.3. Quality and Conformity: The User is solely responsible for the description, condition, conformity, and delivery of the good or the provision of the service offered.
6.4. Regarding Rental, the parties undertake to comply with the laws in force, to use the good in accordance with its intended purpose, to respect the rules of good use and safety, and to formalize their agreement, when necessary, through a written contract specifying the duration, financial conditions, inventory (état des lieux), and responsibilities, as well as, where applicable, the amount and modalities of the security deposit/bond.
7.1. Respect and Loyalty: The User undertakes to use the Platform in a fair manner, in compliance with the laws, these GTU, and with respect for others.
7.2. Responsibility for Content: The User is solely and entirely responsible for the Content they publish. They undertake in particular that this Content:
is not illegal, defamatory, injurious, obscene, racist, hateful, or infringing on privacy;
does not contain viruses, malicious code, or links to illicit content;
7.3. Reporting: The Platform will set up a mechanism allowing Users to report any Content deemed illegal or contrary to the GTU. The Publisher will examine the reports and may remove the Content concerned.
The internal messaging service is intended for exchanges between Users within the framework of transactions or connections. The following are prohibited via messaging: spam, unsolicited commercial prospecting, harassment, threats, requests for sensitive personal information (card numbers, codes, etc.).
The purpose of reviews is to inform the community about the quality of a good or service. The User undertakes to publish reviews that are:
sincere and based on a real experience;
non-remunerated: it is forbidden to publish a review in exchange for financial or material compensation. The Publisher reserves the right to remove any suspicious, false, or manipulated review.
10.1. Publisher's Content: The brand "Troky," the logos, the design, the software, databases, source codes, and all the constituent elements of the Platform are the exclusive property of TrokyLink SARL and are protected by the Intellectual Property Code. Any total or partial reproduction, representation, adaptation, or exploitation is prohibited without prior written authorization.
10.2. License to Exploit User Content: By publishing Content on the Platform, the User grants the Publisher, free of charge, non-exclusively, and for the necessary duration, the right to use, reproduce, represent, adapt, modify, translate, and disseminate this Content on the Platform and the Publisher's communication media (social networks, newsletters, etc.), solely for the purposes of promoting and operating the Platform.
11.1. The Publisher strives to ensure access and proper functioning of the Platform but cannot guarantee the absence of interruptions, errors, viruses, or intrusions. The Publisher cannot be held liable for inconveniences or damages inherent to the use of the Internet.
11.2. The Publisher is not responsible for disputes, damages, or claims resulting from contractual or non-contractual relationships between Users. Each User remains responsible for their commitments and transactions.
11.3. The Publisher cannot be held liable in the event of partial or total non-execution of its obligations resulting from a case of force majeure.
The conditions for the collection and processing of personal data are detailed in the Privacy Policy accessible on the Platform. The User is invited to consult it.
13.1. Duration: These GTU are concluded for an indefinite period from the User's acceptance.
13.2. Termination by the User: The User may terminate their membership at any time by requesting the deletion of their Account according to the procedure provided.
13.3. Termination by the Publisher: In the event of serious or repeated breach of the GTU by the User, the Publisher reserves the right to suspend or terminate the User Account, without notice or compensation, without prejudice to any damages that the Publisher may claim.
The Publisher reserves the right, without prior notice or justification, to moderate, delete, or remove any User Content that violates these GTU or is deemed inappropriate, illicit, or detrimental to the proper functioning of the Platform.
These GTU are subject to modification or update. Modifications will be published on the Platform and the User will be informed via appropriate means. Continued use of the Platform after publication of the modifications constitutes acceptance of the new GTU.
These GTU are governed by Algerian law. In the event of a dispute relating to the interpretation or execution hereof, the parties will attempt to find an amicable solution. Failing this, the competent courts will be those provided for by Algerian law.
